Data protection regulations

General

This website is an offer of FORUM train & sail GmbH. FORUM train & sail GmbH takes data protection seriously. Your data is collected in accordance with the statutory provisions. You can find comprehensive information about this at www.datenschutz.de. In the following, we would like to show you what data we collect from you, what happens to this data and what security precautions we have taken to protect this data from misuse. By providing this transparent and comprehensible information about our data protection provisions, we want to ensure that visitors and customers are well informed about the collection, processing and use of personal data.

Personal data is any information relating to an identified or identifiable natural person (e.g. name, address, telephone number, date of birth or e-mail address). In principle, you can use our online services without providing personal data. However, the use of certain services may require the provision of personal data, e.g. registration or participation in a competition.

All of our company's employees receive regular data protection training and are committed to data protection. Our computer centre and in-house IT department continuously adapt the technical security precautions to the current circumstances and requirements. Both are subject to constant monitoring by our internal processes and the data protection officer. Nevertheless, Internet technologies can have security gaps that cannot guarantee comprehensive protection one hundred per cent. For this reason, our users can also transmit data to us by other means of contact, such as telephone or fax.

I. Information on the processing of your data at FORUM train & sail GmbH (in accordance with Art. 13 and 14 of the GDPR)

In order to create more transparency in the processing of personal data by companies, the European legislator has introduced a new obligation to provide information. As a data subject, you should be informed about what happens to your personal data and the purposes for which it is processed as soon as it is collected. You will receive the following information based on the GDPR:

We process your personal data only in compliance with the relevant data protection regulations. Your data will only be processed if the following legal permissions apply:

  • for the fulfilment of our contractual services
  • processing is required by law
  • if you have given your consent
  • on the basis of our legitimate interests in accordance with Article 6 f GDPR. This is the performance of our business activities, in particular with regard to the well-being of our employees and company owners.


Concrete examples of this are

  • Provision of this online offer and fulfilment of the contract in accordance with our terms of use / general terms and conditions
  • Self-promotion and third-party advertising as well as market research and reach measurement to the extent permitted by law (e.g. Section 7 (3) UWG) or based on consent.

d) Storage duration or criteria for determining the duration

We only store the data you provide to us for as long as is necessary to fulfil the aforementioned purposes or as stipulated by the various storage periods provided for by law. If the respective purpose no longer applies or after expiry of the corresponding periods, your data will be routinely blocked or deleted in accordance with the statutory provisions.

e) Disclosure of data to third parties

We will only pass on your personal data to third parties if this is necessary for the fulfilment of the contract, if we or the third party have a legitimate interest in passing it on or if you have given your consent. In order to fulfil the contract, we pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of ordered goods. To process payments, we pass on the necessary payment data to the credit institution commissioned with the payment and, if applicable, to the payment service provider commissioned by us or to the payment service you selected in the ordering process (e.g. PayPal). We pass on participant lists to our speakers for attendance monitoring purposes. If data is transmitted to third parties on the basis of a legitimate interest, this is explained in these data protection provisions. In addition, data may be transmitted to third parties if we are obliged to do so by law or by enforceable official or court order. The employees of FORUM train & sail GmbH are obliged to maintain confidentiality regarding personal data.

f) Service provider

We reserve the right to use service providers for the collection and processing of data. Service providers only receive the personal data from us that they require for their specific activity. For example, your e-mail address may be passed on to a service provider so that they can deliver a newsletter you have ordered. Service providers may also be commissioned to provide server capacity. Service providers are generally involved as so-called processors who may only process the personal data of users of this online service in accordance with our instructions. 

g) Order processing

Insofar as personal data is collected by the customer in connection with the provision of web-based software applications and product components and thus processed by FORUM train & sail GmbH, this is done by way of order processing in accordance with Art. 28 GDPR. h) Reference to the respective data subject rights

You have the right to receive information about the personal data concerning you. You can also request the correction of incorrect data. In addition, under certain conditions, you have the right to erasure of data, the right to restriction of data processing and the right to data portability. You can object to the use of your data for internal purposes at any time with effect for the future. To assert your rights, please use the information at the beginning of this privacy policy. A simple e-mail to: service(at)forum-verlag.com is sufficient. Please ensure that we are able to clearly identify you personally. Note: For organisational reasons, there may be an overlap between your revocation and the use of your data as part of an ongoing advertising campaign.

If your personal data is processed on the basis of Art. 6 (1) f) GDPR, you have the right to object if there are grounds relating to your particular situation.

i) Reference to the right to lodge a complaint with the supervisory authority

You have the right to lodge a complaint with a data protection authority. To do so, you can contact the data protection authority responsible for your place of residence or your federal state or the data protection authority responsible for us. If you would like to get in touch with us, you can reach us using the contact details at the beginning of this privacy policy. Should you wish to contact FORUM train & sail GmbH by e-mail, we would like to point out that the confidentiality of the information transmitted is not guaranteed. The content of e-mails can be viewed by third parties. We therefore recommend that you only send us confidential information by post.

II. What data we collect in detail and how we use it

Log files

You can visit our website without providing any personal information. However, every time you use the Internet, certain information is automatically transmitted by your Internet browser and stored by us in so-called log files. The log files are stored by us for 90 days solely to investigate faults and for security reasons (e.g. to investigate attempted attacks) and then deleted. Log files whose further storage is required for evidence purposes are excluded from deletion until the respective incident has been finally clarified and may be passed on to investigating authorities in individual cases.

In particular, the following information is stored in the log files:

  • IP address (Internet Protocol address) of the end device from which the online offer is accessed;
  • Internet address of the website from which the online offer was accessed (so-called origin or referrer URL);
  • Name of the retrieved files or information;
  • Date and time;
  • amount of data transferred;
  • Operating system and information on the Internet browser used, including installed add-ons (e.g. for Flash Player);
  • http status code (e.g. "request successful" or "requested file not found").


The provision of personal data may also be required by law (e.g. by tax regulations).

Data collection and use for contract processing and when opening a customer account

We collect personal data if you voluntarily provide it to us as part of your order, when contacting us (e.g. via contact form or email) or when opening a customer account. Which data is collected can be seen from the respective input forms. We use the data you provide to fulfil the contract and process your enquiries. After completion of the contract or deletion of your customer account, your data will be blocked for further use and deleted after expiry of the retention periods under tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you below. Deletion of your customer account is possible at any time and can be done by sending a message to the contact option described below.

Use of data when registering for the e-mail newsletter

If you register for one of our newsletters, we will use the data required for this or separately provided by you to regularly send you our e-mail newsletter. Unsubscribing from the newsletter is possible at any time and can be done either by sending a message to the contact option described below or via a link provided for this purpose in the newsletter. The use of the emails is recorded. You can object to the recording at any time by clicking on the link provided in each email or by sending a message to datenschutzbeauftragter(at)forum-verlag.com.

Use of data for e-mail, fax and telephone advertising and your right to object

If we receive your e-mail address, fax or telephone number in connection with the sale of a product or service and you have not objected to this, we reserve the right to inform you regularly by e-mail, fax or telephone about offers for similar products to those already purchased from our range. You can object to this use of your contact data at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising e-mail, without incurring any costs other than the transmission costs according to the basic rates. Use of data for postal advertising and your right to object

In addition, we reserve the right to store your first and last name, your postal address and - insofar as we have received this additional information from you as part of the contractual relationship - your title, academic degree, year of birth and your professional, industry or business name in summarised lists and to use them for our own advertising purposes, e.g. to send you interesting offers and information about our products by post. You can object to the storage and use of your data for these purposes at any time by sending a message to the contact option described below.

Forwarding to pages of other operators

When you leave our site, for example by clicking on our banner adverts, and reach external sites, so-called cookies may be set by the addressees of the target site clicked on. FORUM train & sail GmbH is not legally responsible for these cookies. For the use of such cookies and the information stored on them by our advertising partners, please compare their data protection declarations.

Data protection in application procedures

We collect personal data from applicants in order to process the application procedure. Your application documents will be checked by personnel officers and, if necessary, several managers of the FORUM subsidiaries. If an employment contract is concluded, personal data will be stored for the purpose of implementing the employment relationship. The statutory regulations are taken into account. In the event of a rejection decision, the application documents will be deleted after two months at the latest. An exception to this is made if, for example, we have to retain the application documents as evidence in proceedings under the General Equal Opportunities Act or if we have other legitimate interests. If we store application documents in our applicant pool for a longer period, we will ask for your consent.

Data protection for minors

As the protection of children's privacy is of great importance, we do not wish to collect, process or use personal data from persons under the age of 18. If you, as a parent or guardian, learn that your children have transmitted their personal data to us, you can contact us at the above addresses if you want the data to be deleted.

III. Information on cookies and integrated applications

What are cookies?

Cookies are small text files that are sent when a website is visited and stored in the user's browser. If the corresponding website is called up again, the user's browser sends back the content of the cookies and thus enables the user to be recognised. Certain cookies are automatically deleted at the end of the browser session (so-called session cookies), others are stored in the user's browser for a specified period of time or permanently and then delete themselves automatically (so-called temporary or permanent cookies).

What data is stored in the cookies?

In principle, no personal data is stored in cookies, only an online identifier.

How can you prevent the use of cookies or delete cookies?

You can deactivate the storage of cookies via your browser settings and delete cookies already stored in your browser at any time. Please note, however, that this online service may not work or only work to a limited extent without cookies. Please also note that objections to the creation of user profiles sometimes work via a so-called "opt-out cookie". What kind of cookies do we use?

Strictly necessary cookies

Certain cookies are necessary so that we can provide our online services securely. This category includes, for example, cookies that serve to identify or authenticate our users; cookies that temporarily store certain user entries (e.g. the contents of a shopping basket or an online form); cookies that store certain user preferences (e.g. search or language settings); cookies that store data to ensure the trouble-free playback of video or audio content.

Usercentrics

On our website, we use the cookie consent technology of Usercentrics GmbH, Rosental 4, 80331 Munich, Germany (hereinafter "Usercentrics") to obtain your consent to the storage of certain cookies on your end device and to document this consent in accordance with data protection regulations. Usercentrics uses a cookie in order to be able to assign the consent(s) given to you as well as their revocation.

The data collected by Usercentrics is processed on our behalf and on the basis of an order processing contract.

Usercentrics is used to obtain and manage the legally required consents for the use of cookies. The legal basis for this is Article 6(1)(c) GDPR.

Matomo

We use "Matomo" (formerly "PIWIK") on this website for statistical analysis. This is an open source tool for web analysis. With Matomo, data is only transmitted to our servers and not passed on to third parties. Matomo is deactivated when you visit our website. Your usage behaviour is only recorded anonymously if you actively consent to this. Your IP address is anonymised immediately; you therefore remain anonymous as a user.

During your visit to our website, the following data is collected, among others:
- the pages you have called up, your "click path"
- Achievement of "website goals" (conversions, e.g. newsletter registrations, downloads, purchases)
- Your user behaviour (e.g. clicks, dwell time, bounce rates)
- Your approximate location (region)
- Your IP address (in abbreviated form)

Google Maps

We use Google Maps on our website to display our location and to provide directions. This is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as "Google". If you call up the Google Maps component integrated into our website, Google stores a cookie on your end device via your Internet browser. Your user settings and data are processed in order to display our location and provide directions. We cannot rule out the possibility that Google uses servers in the USA. The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in optimising the functionality of our website. The connection to Google established in this way enables Google to determine from which website your enquiry has been sent and to which IP address the directions are to be transmitted. Google Fonts

We use Google Fonts on our website to display external fonts. This is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as "Google". In order to enable the display of certain fonts on our website, a connection to the Google server in the USA is established when our website is accessed. The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the optimisation and economic operation of our website. The connection to Google established when you access our website enables Google to determine from which website your enquiry has been sent and to which IP address the display of the font is to be transmitted. Google reCAPTCHA

We use Google reCAPTCHA on our website to check and prevent interactions on our website through automated access, e.g. by so-called bots. This is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as "Google". This service enables Google to determine from which website an enquiry is sent and from which IP address you use the so-called reCAPTCHA input box. In addition to your IP address, Google may also collect other information that is necessary for the provision and guarantee of this service. The legal basis is Art. 6 para. 1 lit. f) GDPR. Our legitimate interest lies in the security of our website and in the defence against unwanted, automated access in the form of spam or similar. Use of Google Remarketing

This website uses the remarketing function of Google Inc. This function is used to present interest-based adverts to website visitors within the Google advertising network. A so-called "cookie" is stored in the website visitor's browser, which makes it possible to recognise the visitor when he or she visits websites that belong to the Google advertising network. On these pages, the visitor can be presented with adverts that relate to content that the visitor has previously accessed on websites that use Google's remarketing function. According to its own information, Google does not collect any personal data during this process. However, if you do not wish to use Google's remarketing function, you can deactivate it by changing the relevant settings under http://www.google.com/settings/ads to do so. Alternatively, you can deactivate the use of cookies for interest-based advertising via the advertising network initiative by following the instructions at http://www.networkadvertising.org/managing/opt_out.asp follow.

Use of Facebook retargeting

We would like to present our users with adverts or special offers tailored to their interests ("interest-based advertising") and limit the frequency with which certain adverts are displayed. For this purpose, we use Facebook's Website Custom Audiences tool and the Facebook pixel. The Facebook pixel is a JavaScript code that sends the following data to Facebook Ireland Ltd, Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"): - HTTP header information (including IP address, web browser information, page location, document, website URL and web browser user agent, and day and time of use); - Pixel-specific data; this includes the pixel ID and Facebook cookie data, including your Facebook ID (this is used to link events to a specific Facebook advertising account and associate them with a Facebook user); - Additional information about the visit and about standard and custom data events. We use the following custom data events: Searched and viewed content at product level; product was added to shopping basket; initiation of a checkout in the order process; and completion of the order process. Facebook uses the hashed user-specific Facebook ID (contained in the Facebook cookie) to automatically check whether the data transmitted by the Facebook pixel can be assigned to a Facebook user. If no Facebook cookie is stored in your browser, no categorisation into one of the user groups referred to as "Custom Audience" is carried out.

If the Facebook ID contained in the Facebook cookie can be assigned to a Facebook user, Facebook assigns this user to a "Custom Audience" based on the rules we have defined, provided that the applicable criteria are met. We use the information obtained in this way to display adverts on Facebook ("Facebook Ads"). However, adverts are only displayed to a "Custom Audience" of 20 or more different users, meaning that no conclusions can be drawn about the characteristics of the individual users from the ad placement. The assignment to a "Custom Audience" takes place for a maximum of 180 days. This period begins again if you visit our website again and there is a match with the same "Custom Audience" rules. Facebook can assign your visit to our website and your associated activities to your Facebook user account. This is not possible for us. We only receive statistical information from Facebook about the use of our website via Audience Insights. Facebook forwards your data to Facebook Inc, Facebook 1 Hacker Way Menlo Park, CA 94025, USA and uses your data to improve the quality of its advertising by, among other things, improving the optimisation algorithm used by Facebook to display Facebook Ads and the News Feed ranking. Right to object: If you wish to object to the use of Facebook Website Custom Audiences, please click here. An opt-out cookie will then be set to prevent the transmission of data via the Facebook pixel. This opt-out cookie generally has an unlimited duration of effect. Please note, however, that the opt-out function is device- or browser-specific and only applies to the device or browser you are currently using. If you use several end devices or browsers, you must opt out on each individual end device and in each browser used. If you delete all cookies in your browser, an objection may also no longer be taken into account and you will have to raise it again.

LinkedIn

Our website uses functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Each time one of our pages containing LinkedIn functions is accessed, a connection to LinkedIn servers is established. LinkedIn is informed that you have visited our website with your IP address. If you click on the LinkedIn "Recommend" button and are logged into your LinkedIn account, LinkedIn is able to associate your visit to our website with you and your user account. We would like to point out that, as the provider of the pages, we have no knowledge of the content of the transmitted data or its use by LinkedIn. Use of messenger services

By sending a start message to FORUM train & sail GmbH (hereinafter referred to as the sender), you consent to the sender using my personal data (e.g. surname and first name, telephone number, messenger ID, profile picture, messages) for direct communication and the data processing required for this purpose using the selected messenger in each case in accordance with Art. 6 para. 1 lit. a GDPR. An existing messaging account with the respective provider is required to use this service.

The respective provider receives personal data (in particular communication metadata), which is also processed on servers in countries outside the EU (e.g. USA) where an adequate level of data protection cannot be guaranteed. Your consent to this data processing can be freely revoked at any time by entering "STOP" in the respective messenger. To have all your data stored with our service provider removed, send a message with the text "DELETE ALL DATA" via your messenger.

Use of our customer chat

This website uses technology from JivoSite Inc, 525 W. Remington Drive, Sunnyvale, CA 94087, USA, (www.jivochat.com) to collect and store anonymised data for the purpose of web analysis and to operate the live chat system for answering live support enquiries. This anonymised data can be used to create user profiles under a pseudonym. Cookies can be used for this purpose. Cookies are small text files that are stored locally in the cache of the website visitor's Internet browser. Cookies make it possible to recognise the Internet browser. The data collected using jivochat technologies will not be used to personally identify the visitor to this website and will not be merged with personal data about the bearer of the pseudonym without the separately granted consent of the person concerned. In order to avoid the storage of jivochat cookies, you can set your Internet browser so that no more cookies can be stored on your computer in future or cookies that have already been stored are deleted. However, switching off all cookies may mean that some functions on our website can no longer be carried out. You can object to the collection and storage of data for the purpose of creating a pseudonymised user profile at any time with effect for the future by sending us your objection informally by e-mail to the e-mail address given in the legal notice

Use of ZOOM (video conferencing tool)

Purpose of the processing
We use the "Zoom" tool to conduct telephone conferences, online meetings, video conferences and/or webinars (hereinafter: "online meetings"). "Zoom" is a service provided by Zoom Video Communications, Inc. based in the USA. Participation in an online event organised by FORUM train & sail does not require you to create a user account with ZOOM. It is sufficient if you follow the link contained in the invitation e-mail and log in via the web interface. However, you must at least enter your name and e-mail address in order to participate so that FORUM train & sail can identify you as an authorised participant.

What data is processed?
During your participation in an online event, various metadata (e.g. IP address, device/hardware information), connection data (e.g. phone number, country name, start and end time) and content data (e.g. chat history, Q&A, audio, video) are also processed. The meta and connection data is information that is necessarily generated when using ZOOM. Otherwise, no connection to you and the end devices used can be established. You are in control of which content data is processed via ZOOM. You can switch off the camera or microphone yourself at any time and prevent the processing of data in this way. Use of the chat function is also voluntary. Automated decision-making in accordance with Art. 22 GDPR is not used. If you have created a user account with ZOOM, the data protection information of Zoom Video Communications, Inc. also applies.

The permissibility of the use of ZOOM is based on Art. 6 para. 1 b) GDPR. Online events are an alternative and supplement to traditional face-to-face events and are increasingly in demand as digitalisation progresses. As a provider, FORUM train & sail must adapt to the needs of companies and offer flexible solutions. The use of software applications such as ZOOM is an important component of this. The interactive organisation and implementation of online events requires software with appropriate functions and capacities. FORUM train & sail has opted for ZOOM because it is the most suitable application.

In order to participate in an online event, the processing of meta and connection data as well as your name and e-mail address is mandatory. The provision of further information is voluntary. However, you will then not have the opportunity to actively participate in the online event and, for example, ask a question.
The recipients of your name and the content data generated by you during processing via ZOOM are the persons with whom you communicate via the service. These may be employees of FORUM train & sail or other participants.

An adequate level of data protection is ensured by the agreement of EU standard contractual clauses.

The content data processed during an online event will not be recorded or stored without your consent. However, the chat history and the questions you ask the speaker can be viewed until the end of the online events. The meta and connection data are stored in accordance with the provisions of the Telecommunications Act and the Telemedia Act for the purposes of billing and maintaining system security. Name and e-mail address are stored in ZOOM for a period of 6 months and then deleted.
